Manfrotto Terms and Conditions

By joining this group and participating in the Irys x Manfrotto photo contest, you agree to the following terms and conditions. These terms and conditions apply in addition to the Irys Terms of Use and Privacy Policy and do not replace them.
1.0 Organiser of the photo contest:
Silvertone Media Ltd (owners of The Irys Photos App), a UK company with its principal office located at C/O Gravita Oxford Llp, First Floor, Park Central, 40/41 Park End Street, Oxford, United Kingdom, OX1 1JD (“Irys”).
2.0 Theme
The competition theme will be determined by Irys and Manfrotto for each competition round.
3.0 Duration
The duration of each competition round is 1 month. The current dates will be communicated via the corresponding Spotlight group.
4.0 Procedure
4.1 Judging will be carried out by Irys and Manfrotto after the end of the respective competition round.
4.2 After judging, the winner's details (name, email address, delivery address, etc.) will be passed on to Manfrotto by Irys.
4.3 If a winner does not respond within 14 days of notification, the claim to a prize shall expire and Irys and Manfrotto may select another winner as a replacement.
5.0 Prizes The prizes and/or vouchers offered by Irys and Manfrotto under “Prizes” will not be paid out in cash and cannot be exchanged. Prizes cannot be transferred to third parties.
6.0 Participation
6.1 To participate, a premium user account must be created or already exist in the Irys App.
6.2 Up to a maximum of 6 self-taken photographs that reflect the theme of the respective competition can be submitted in the individual photo competitions.
6.3 Participation is only possible online via the Irys app or Spotlight group of the competition. Submissions by post or by any other means cannot be considered.
6.4 By uploading the photos, the participant agrees to the terms and conditions of participation.
7.0 Eligibility
7.1 Natural persons who have reached the age of 18 are eligible to participate.
7.2 Participation is not limited to Manfrotto customers and is not dependent on the purchase of goods or services.
7.3 If participants are restricted in their legal capacity, the consent of their legal representatives is required.
7.4 All persons involved in the conception and implementation of the competition, as well as employees of Irys and Manfrotto and their relatives, are not eligible to participate.
8.0 Permitted formats
8.1 Files must be at least 1,080 x 1,080 pixels in size for uploading. Only PNG, JPG, and JPEG file formats are permitted.
8.2 All submitted photographs must have been taken with a lens-based camera. Content generated exclusively by computer or artificial intelligence is not permitted, and no artificially generated fillings may be used in post-processing. Submitted photographs may be edited as long as this does not result in significant changes to the image as a whole or alter the meaning of the image, add new information to the image, or remove information from the image that was captured by the camera. The extent of the editing must be made transparent in the image description when submitted by the participant.
8.3 Each submitted photograph must also be available to the participant in its original size and format (JPEG, RAW, or TIF). Irys and Manfrotto may request this from the participant for authenticity verification (see section 11.5) and for publication in exhibitions and/or print media (see section 11.1).
8.4 The participant has the unrestricted copyright and rights of use for the submitted photographs. The motifs must not contravene the legal provisions of the country of origin, the legal provisions of the European Union, or the personal rights of the persons depicted.
9.0 Newsletter
9.1 By participating in the competition, the participant agrees that Irys and Manfrotto may contact them by email and print mailings by post for matters relating to the current competition and future and/or past competitions. This includes, in particular, information on the following topics: duration, theme, prizes, content related to the charitable cause, content related to the jury and judging, participation, winners, winners' page, award ceremony, interviews, and announcements.
9.2 Participants may unsubscribe at any time via a link contained in the newsletter.
10.0 Rights of participants
10.1 Copyright Irys and Manfrotto do not acquire copyright to the participants' photographs at any time.
10.2 Participants may withdraw their photographs from the competition at any time by deleting the photograph in question. This does not apply to photos that are displayed on the “Winners” page after judging and/or have already been published under the conditions specified in section 11.1. The deletion of photographs selected by the jury and photographs already published under the conditions specified in section 11.1 will be carried out by Irys at the participant's request.
11.0 Rights of the organiser
11.1 Right of use By participating in the competition, the Images submitted by the Winners and those on the shortlist grant Irys and Manfrotto an irrevocable, spatially unlimited, and temporally unlimited right of use to use the submitted photographs for PR purposes. This shall occur exclusively in connection with this photo competition or future photo competitions – including any subsequent communication in which the participant has been involved – and includes the possibility of publication, reproduction, illustration, and distribution for the purpose of non-commercial self-promotion and self-representation by Irys and Manfrotto. For the sake of clarity, the title of a photograph may be translated.
When photographs submitted are published by Irys and/or Manfrotto, the name of the participant will be credited as the author wherever possible.
Permission includes the use of the submitted photographs for the following purposes:
- The judging of the Irys x Manfrotto Award.
- The presentation of the winners.
- The award ceremony for the Irys x Manfrotto Award.
- The presentation of the achievements of the Irys x Manfrotto Award.
- Publication on all media channels of Irys and Manfrotto and companies associated with Irys and Manfrotto – online and offline – for example, websites, print, newsletters, and social networks (including adaptation to the format of the respective channels, if necessary).
- Presentation in exhibitions and auctioning of exhibition pieces for a good cause. The print size and format will be approved by the photographer.
- Inclusion in publications, including publications by third parties in press reports.
Any commercial use beyond this requires the separate consent of the participant.
The publication of photos within the scope of the publication conditions is free of charge.
11.2 Irys and Manfrotto reserve the right, at their sole discretion, to exclude persons from participating in the competition and to disqualify them from any prizes if there are justified reasons for doing so. These reasons may include, in particular:
- Violations of these conditions of participation
- Unfair practices
- Manipulation aimed at improving the chances of winning or obtaining comparable advantages
- False or misleading information provided by the participant before, during, or after the competition.
11.3 Irys and Manfrotto reserve the right, at their sole discretion, to exclude submitted photographs from the competition and to delete them if there are legitimate reasons for doing so. These may include, in particular, the following cases:
- Submissions that deviate significantly from the thematic guidelines.
- Submissions that have been altered with frames, watermarks, or vignettes.
- Submissions that violate the law, glorify violence, contain pornography, racism, or other offensive content, or violate public decency, or are intended to manipulate the competition.
- Submissions that were created using the tools mentioned in section 8.2 (e.g., artificial intelligence and other editing techniques) and where the participant concealed the use of these tools.
11.4 The participant will be informed separately by Irys and Manfrotto about their exclusion from the competition, the revocation of their prize, or the deletion of submitted photographs.
11.5 If, during the evaluation process, questions arise regarding the extent of editing of a submission, Irys and Manfrotto may request the participant to submit the original photo and image file for review. If no original file is available, Irys and Manfrotto have the right to exclude the submitted photograph from further participation in the competition.
12.0 Liability
12.1 Participants must hold the unrestricted copyright and usage rights, and the motifs must not contravene the legal provisions of the country of origin, the legal provisions of the European Union and the UK, or the personal rights of the persons depicted.
12.2 By participating, the participant confirms that they are the author of the uploaded photographs and thus have unrestricted rights of use and may submit them to the competition. The participant further confirms that the photographs uploaded by them are free of third-party rights; in particular, that the property and likeness rights of third parties are not infringed by these uses. The participant hereby indemnifies Irys and Manfrotto against any claims by third parties.
12.3 Irys and Manfrotto accept no liability for the protection of copyright by third parties.
12.4 The participant warrants that the contents of the image files transferred do not violate applicable prohibitive norms, in particular the provisions on the distribution of child pornography.
12.5 In some countries, import sales tax and/or customs duties may be levied on the prizes. It is the responsibility of the winner to pay all import sales taxes and/or customs duties associated with the prize in accordance with the laws of their country. In such cases, the winner agrees to indemnify Irys and Manfrotto and their affiliates or partners from any tax liability, fees, fines, penalties, or interest, or any other liability incurred by the winner as a result of the prizes made available to them.
13.0 Final provisions
13.1 Legal recourse is excluded.
13.2 This agreement is governed by UK law. The place of jurisdiction is London, UK.
13.3 Severability clause Should any provision of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
